Terms and conditions

I. General Statements.

1. GreenParking.biz, hereinafter “Green Parking”, refers this agreement to any individual.
2. By accepting the terms of this Agreement and registering for Green Parking services an individual accepts the agreement and becomes a Subscriber.
3. All the services provided to Subscriber are listed and described on Subscriber’s Personal Page.
4. Authentication features are provided to Subscriber only after correct passing by him registration procedure.

II. Subject of the Agreement.

1. Green Parking provides Subscriber with the services in compliance with the terms and conditions of the Agreement.
2. Subscriber uses the services in accordance with the terms and conditions of the Agreement.
3. The complete list of services currently available to Subscriber, their technical details and also the statement of personal account are set on Subscriber’s Personal Page.

III. Rights and Obligations of the Parties.

Green Parking accepts the obligation:

1. To provide access to Subscriber’s Personal Web-Page to any individual who has completed the registration process.
2. To provide access to the services as set forth on the Subscriber’s Personal Web-Page after the required registration is completed.
3. To grant the Subscriber the right to independent control of the services and the resources provided for this purpose through Subscriber’s Personal Web-Page.
4. To provide execution of Subscriber’s orders made on his Personal Web-Page.
5. To provide daily record of services used by Subscriber and publish this information on Subscriber’s Personal Web-Page.
6. To provide financial daily accounting of Subscriber’s funds and publish this information on Subscriber’s Personal Web-Page.
7. To keep private exchanged with the Subscriber, including any of its correspondence with the Subscriber as well as the data from Subscriber’s Personal Web-Page.
8. To provide the Subscriber with the information related to the use of services to the E-mail address specified on Subscriber’s Personal Web-Page.

Subscriber accepts the obligation:

9. To learn thoroughly all the terms and conditions of this Agreement.
10. To provide valid personal details for the registration procedure.
11. To check amendments and supplements to this Agreement, statistics of services use the Subscriber’s financial information.
12. To provide reliable and actual information on his Personal Web-Page. Any changes of personal information must be immediately submitted by the Subscriber to his Personal Web-Page.
13. To maintain privacy of his account information (email and password) obtained from Green Parking in accordance with the agreement.
14. Not to make attempts to get unauthorized access to servers and databases on the Internet.
15. To inform Green Parking at once about any problems related to authorization and/or other failures while using Green Parking services.
16. Not to damage Green Parking software and hardware.
17. Not to load Internet channels with waste traffic having the purpose to impede operation of other Subscribers or servers on the Internet.

Green Parking has the right:

18. To stop providing services to Subscriber in the following cases:

    - Subscriber takes acts that can restrict or hamper other Subscribers’ access to Green Parking services;

    - Subscriber attempts to make unauthorized access to Green Parking resources or other systems that can be reached via the Internet;

    - Subscriber making postings or/and publishing via the Internet any information infringing international law, morality standards or impairing the rights of third parties;

    - Subscriber publishing or transferring any data or software that contain viruses or virus related components;

    - Subscriber taking any making actions targeted at posting, publishing transferring, reproducing or distributing in any way, and also using software or/and any other materials obtained through Green Parking services fully or partially protected by intellectual property or any other rights without the permission of the owner;

    - Subscriber posting commercial or any other E-mail messages (spam) with no prior arrangement or coordination with the receiver;

    - If the traffic to be illegal in nature such as done by any non-human process like robots, scripts or other software;

    - If the traffic is a subject to objectionable content including, but not limited to content that is misleading, libelous, defamatory, obscene, violent, bigoted, hate-oriented, illegal, and/or promoting illegal goods, services or activities.

19. To change terms for the provided services.
20. To make one-sided changes in terms and conditions of the Agreement concerning the service level. Subscriber will be notified not less than upon 7 (seven) days prior to introducing these changes by means of publishing a message on Green Parking web-site setting the date of putting them in force. If no written refusal to accept the new conditions is obtained from Subscriber at Green Parking E-mail info@GreenParking.biz, the stated changes are considered to be accepted by Subscriber.
21. Green Parking has the right to suspend providing services for performing routine maintenance in accordance with Service Level Agreement.

Subscriber has the right:

22. To demand that Green Parking should provide services in accordance with terms and conditions of this Agreement.
23. To control services and resources dedicated for them via Subscriber’s Personal Web-Page.
24. To terminate this Agreement.

IV. Service Procedure and Payment Terms.

1. The registration procedure is mandatory for all Subscribers. The registration form is available on Green Parking Sign UP page (https://greenparking.biz/register.php).
2. After submitting correctly and fully the registration form Subscriber obtains:

   - Subscriber’s personal identification details intended for unique identification of Subscriber in the process of service providing. Email and Password to Personal Web-Page are Subscriber’s identification details;

   - Subscriber’s Personal Web-Page intended for automatic service control and obtaining all the needed information related to providing him services by Green Parking.

3. Subscriber’s Personal Web-Page is the main interface of communication between Subscriber and Green Parking. Subscriber himself sets the parameters, volumes and terms of the services via his Personal Web-Page and Green Parking performs Subscriber’s orders subject to that input.

V. Special Terms and Obligations of the Parties.

1. Green Parking is not liable for normal operation and accessibility of Internet segments by means of which Subscriber’s access to parking services is provided.
2. Green Parking makes no guarantees concerning the opportunity of Subscriber’s data exchange with sites and servers that are temporary or permanently inaccessible via Internet.
3. Green Parking is not liable to Subscriber or third parties for any delays and/or interruptions in the process of service providing and also concerning damages or losses caused by defects in any software or hardware that is not the property of Green Parking.
4. Green Parking is not liable for infringement the rights of third parties arising out of Subscriber’s activities on placing information and/or other actions made on Internet by employing services provided by Green Parking.
5. Subscriber is liable for his password safety and for the losses that can arise from unauthorized use of it. In order to prevent such situations, Subscriber must immediately change his password in case of any breach in password security.
6. In case of loss of account information Subscriber may apply to Green Parking to change account information (email and password). The process of changing account information is performed by Green Parking maintenance service. Subscriber is to answer this message keeping the original text of the inquiry in the body of the message.
7. Green Parking is not liable for any obligations or expenses resulting from the breach of some points of the Agreement by Subscriber or other parties using his email and password; or arising from Internet use through the Services; or as a result of posting or delivering messages, information, software, or any other materials on the Internet by Subscriber or other parties using his email and password.
8. The parties take obligations under this Agreement in accordance with the legislation applicable.
9. Subscriber takes obligation not to infringe the rights of third parties while using intellectual property items provided through Green Parking services. If this section of the Agreement is broken, Green Parking has the right to suspend providing services till the claims of third parties are settled.
10. In case of force-majeure events (acts of God, epidemics, fire, strikes, military operations, unfavorable regulations taken by Government or other natural, political or any other events that can’t be reasonably controlled by the Parties), the Parties are not responsible for failure to meet obligations upon this Agreement. If such circumstances keep for more than thirty days, a Party has the right to terminate the Agreement; such termination comes into force immediately.

VI. Term of the Agreement, Modification and Termination Procedure.

1. The Agreement comes into force upon Registration by Subscriber.
2. A party may terminate this Agreement upon 15 days prior written notice sent by E-mail.
3. Green Parking reserves the right to terminate this Agreement if:

   - Subscriber breaches terms and conditions of this Agreement;

4. Termination of the Agreement comes into force on the date of sending message on the point to the address stated on Subscriber’s Personal Web-Page.

VII. Other Conditions.

1. All notifications and messages sent by the Parties to each other by E-mail are considered by the Parties to be official correspondence in the scope of this Agreement. The recipient Party is responsible for receiving messages and notifications.
